What Happens If You Miss the VAT Filing Deadline in UAE?
Missing your VAT filing deadline in the UAE is more serious than most business owners realise. The Federal Tax Authority (FTA) imposes automatic financial penalties β and they can add up quickly if left unresolved. Here's exactly what happens and what you should do about it.
What Is the VAT Filing Deadline in UAE?
VAT-registered businesses in the UAE must file a VAT return with the FTA either:
- Quarterly β within 28 days after the end of each tax period
- Monthly β for businesses assigned a monthly filing cycle
For example, if your tax period ends on 31 March, your VAT return and payment are due by 28 April.
What Happens If You Miss the Deadline?
The FTA applies penalties automatically through the EmaraTax portal. You do not receive a warning β the fine is applied the moment the deadline passes.
Penalty for Late VAT Filing
If you fail to submit your VAT return on time, the FTA imposes:
- AED 1,000 for the first time you miss the deadline
- AED 2,000 if you miss the same deadline again within 24 months
Penalty for Late VAT Payment
If you file on time but fail to pay the VAT amount due, an additional penalty applies:
- 2% of the unpaid tax β immediately after the due date
- 4% of the unpaid tax β if still unpaid after 7 days
- 1% daily penalty β on any amount still unpaid after one month, up to a maximum of 300%
This means a delayed payment can become extremely costly very quickly.
Real Example
Suppose your VAT return was due on 28 April and you owed AED 10,000 in VAT:
| Timeline | Penalty |
|---|---|
| Day 1 (29 April) | AED 1,000 late filing + AED 200 (2% of AED 10,000) |
| Day 8 | Additional AED 400 (4% of AED 10,000) |
| Day 31 onwards | 1% per day on outstanding amount |
A simple oversight can quickly turn into thousands of dirhams in penalties.
What Should You Do If You've Already Missed the Deadline?
Step 1 β File Immediately
The sooner you file, the lower your penalty. Do not wait β every day adds more cost.
Step 2 β Pay the VAT Due
Log in to your EmaraTax account and make the payment as soon as possible to stop the daily penalties from accumulating.
Step 3 β Apply for a Penalty Waiver
The FTA has a penalty reconsideration process. If you have a valid reason β such as a medical emergency, system error, or first-time mistake β you can apply for a full or partial waiver of the penalties.
Step 4 β Set Up a Reminder System
Use a calendar reminder or work with a registered tax agent to ensure you never miss a deadline again.
Can You Get the Penalty Waived?
Yes β the FTA allows businesses to apply for penalty reconsideration under certain circumstances. To apply:
- Log in to EmaraTax
- Go to My Correspondence
- Submit a Reconsideration Request with supporting documents explaining why you missed the deadline
However, waivers are not guaranteed. The FTA reviews each case individually.
How to Avoid Missing VAT Deadlines
- Set calendar reminders 2 weeks before each filing deadline
- Work with a registered tax agent who handles filing on your behalf
- Keep your accounting up to date monthly so your VAT return is easy to prepare
- Register on EmaraTax and check your portal regularly for notifications
